This is a question people ask often. As we have previously mentioned, hiring an attorney represents an extra cost, and not everyone is willing to afford it.
Yes, you can file your trademark on your own. But you are taking risks:
– You have no expertise on the subject, even if you study it.
– You do not have the experience that an attorney has.
– You do not have the tools to perform the correct search, no Google does not count.
– you do not have the clarity to determine in which class your trademark should be filed.
– You are not used to filing forms, you may do it wrong.
– In the event of any office action, opposition or mistake on your file, the Trademark Office will ask you to amend the matter with an attorney. So, the money you “saved” by filling it yourself, you need to spend it in solving the issue.
