Can I reproduce someone else’s portrait?

 

 

Any person’s portrait cannot be commercialized without their consent. On the event that the person has died, it will be the spouse, descendants or heirs who must give authorization. In case of their absence, meaning if there are no heirs, the publication will be free.

 

Notwithstanding the above, any person that had given the consent can revoke it any time, claiming damages.

 

There is one exception in cases in which the publication had scientific, didactic or culture purposes, or the events have a public interest or they have occurred in public. In such cases, no authorization is required.
