We use the word influencers to make reference to people that, due to their name and knowledge on a certain sector or any other reason, they have an attraction power on those who follow them on social media (their followers), so they can persuade their behaviors or decisions.
Depending on their field, we refer to them as bloggers, youtubers, instagramers, twitters, podcasters, tictokers, among others or relating to their market, such as booktubers, foodies, gamers, etc.
Companies often approach them, so they can suggest their products or services and, based on the amount of people following them, they look for sales improvement.
What does an influencer need to know to make sure they are not violating any Intellectual Property?
– All influencers create content, however if within the content they use pics, videos, music, etc., that belong to somebody else, they must get their permission to use it.
– They must also have in mind the legal terms on the website (terms and conditions or terms of use) in the platform they use, in order to make sure that the created content does not infringe any of them.
– They must be in alignment with their countries’ laws and never upload any content that is inappropriate. The consequences of not doing it may even lead them to contract termination with the companies they are currently working with, since no company wants to be associated with inadequate content.
